How to get a Corporate Power of Attorney to be used in Mexico?

 

Do you want to have a corporate power of attorney, so a third person in Mexico can perform certain procedures on behalf of a company? 

There are two kind of POA's:

◊ General: This POA can be either for LAWSUITS AND COLLECTIONS; ADMINISTRATIVE ACTS; ACTS OF OWNERSHIP or for the three of them.

General powers can be limited, which allows the representative to perform certain activities related to a specific procedure. 

◊ Special: This POA specifies the procedure to be performed by the representative.

IMPORTAN: If the requested Power of Attorney involves ownership or administrative acts, the grantor's marriage certificate must be presented, if applicable. 

Steps to be followed for a corporate POA request:

  1. Application form Download it here (Spanish only)
  2. Document in .word format with the purpose of the POA, limitation, validity etc. 
  3. Valid passport of the grantor.
  4. If the requested Power of Attorney involves ownership or administrative acts, the grantor's marriage certificate must be presented, if applicable. 
  5. Proof of address of the grantor (invocie or personbevis)
  6. Copy of the identification of the representative in Mexico.
  7. If you do not speak Spanish, please designate a trusted-person to be your translator and send copy of his/her passport, along with the following information: civil status, ocupation, address and phone number. (The translator shall be present during the appointment) 
  8. Certificate of legal incorporation: A document issued by the local authority, no older than six months, certifying that the company or legal entity is legally established. This document must be in English or in Swedish with an official translation into Spanish and duly apostilled.
  9. Proof of authority: A document confirming that the grantor has the authority to grant powers of attorney of any kind on behalf of the company. This document may be issued by the company itself, signed by the partners, and must be in English. It must then be notarized and apostilled.
