Requirements and procedure to get married in Italy

In relation to the requirements and procedure to get married in Italy, in particular regarding the "Nulla Osta", we inform that based on circular number 11, dated September 22, 2015, the Ministry of the Interior of Italy instructed the officers of the Italian Civil State to accept the certificates issued by the various offices of the Civil Registry of the United Mexican States as valid documents to celebrate marriages of Mexican nationals in this country, replacing the document called Nulla Osta. In this sense, Mexican nationals do not require the Nulla Osta, but they do require the presentation of the Mexican document called "Constancia de Inexistencia de Registro" or "Certificado de Soltería". The Consulate is not authorized to issue the "Constancia de Inexistencia de Registro" or "Certificado de Soltería". The Federal Civil Code establishes that the civil status of the person is verified only with the certificates issued for this purpose by the Civil Registry (of each state of the Republic) in Mexico. This document can be requested by a family member, in case you are unable to request it, before the Civil Registry of the state of your birth or residence. The name of the certificate may vary depending on the State of the Mexican Republic. This document should not be older than 6 months from the date of the marriage in this country (it is recommended to verify the validity of this document with the authorities of the Commune where you will celebrate your marriage in Italy).

Also, the certificate issued by the Civil Registry in Mexico must be apostilled by the competent authority in Mexican territory and translated by an authorized translator into Italian, since all Mexican documents, in order to be officially valid in Italy, must be apostilled. It is recommended to carry out such translation in Italy with an authorized expert translator, in order to avoid doubts as to the validity of the translation and to legalize such translations in Italy. It is reiterated that the apostille of Mexican documents can only be done in Mexico, since the Consulate does not have the authority to apostille Mexican public documents. The apostille process must be carried out in the country of origin of the document, i.e. Mexico. It can be done personally or by third parties at the corresponding offices.

Please be advised that the apostille is an international certification of public documents issued by the authorities of the countries that are parties to the Hague Convention, including Mexico and Italy. Its purpose is the recognition of public documents among the adhered countries, without requiring additional or subsequent legalization.
