The Consular Section of the Embassy of Mexico in Austria, concurrent to Slovakia and Slovenia, is authorised to authenticate the following notarial acts, if they are to have legal effect in Mexico:
- Issuing of a General or Special Power of Attorney;
- Withdrawal of a General or Special Power of Attorney, only if issued in Mexico or another Mexican Consulate;
- Issuing of an Open Public Will;
- Repudiation of an inheritance.
These acts are notarised into public deed and do not require subsequent legalisation or notarisation to have legal effect in Mexico.
NOTE: Due to the legal importance of a notarial act, the Consular Section does NOT offer URGENT notarial services.
POWER OF ATTORNEY
When a person living abroad has to perform a legal act in Mexican territory, he/she can be represented by granting a power of attorney for this purpose. There are general or special powers of attorney.
They can be as follows:
- General Power of Attorney for Lawsuits and Collections. They are used to represent in lawsuits and to collect payments on behalf of the principal.
- General Power of Attorney for Administrative Actions. They are used to manage assets and interests of the principal.
- General Power of Attorney for Ownership Actions. They are used to buy, sell or mortgage assets on behalf of the principal.
- Special Power of Attorney
The General Power of Attorney is valid for a series of indefinite acts, so that the agent can perform multiple acts on behalf of the principal until it is withdrawn or until one of the parties dies. However, at request, the power of attorney may be limited in terms of the powers bestowed upon the agent.
The Special Power of Attorney is granted for representation in one or several specifically determined matters and ends automatically with the settlement of the matter(s). Frequently, private institutions, such as banks, insurance companies, etc., need this type of power of attorney.
Requirements:

- Copy of valid passport
- Copy of marriage certificate (if necessary)
- Payment of fees on the day of your appointment by card (Visa, MasterCard or Maestro) according to the current public fees (follow this link)

After we receive your documents and verify that they are complete, a draft power of attorney will be prepared. Only if the applicant accepts the draft power of attorney, the Consular Section will give an appointment for signature. You must bring the required documents in original to your appointment. It is advised that the draft is previously sent to a law firm or a notary public in Mexico for review.
NOTICE:
- If a natural person represents a LEGAL PERSON, he/she must present public documents, in original or certified copy, apostilled and translated into Spanish by a certified translator, that accredit the legal foundation of the company, its operation, corporate purpose, domicile (company agreement); the statutes that determine its administrative bodies and their powers (company statutes); and the commissioning of the person to grant the power of attorney (minutes of the meeting).
- Documents issued outside Austria, Slovakia, Slovenia or Mexico must be apostilled by the competent authorities of the issuing country. If they are in a language other than Spanish, they must be presented with a translation by a sworn and court certified translator (follow this link).
- FOREIGN CITIZENS: You must confirm that you have read and understood the text in Spanish. If this isn't the case, you must come to the appointment with a sworn and court certified translator (follow this link), who will act as witness for the comprehension and authorisation of the power of attorney to be granted in a language you do not speak. The Consulate reserves the right, until the day of the appointment, to verify your knowledge of Spanish.
- Consulates are NOT authorized to provide translations of any kind.
An authentication is the comparison of an original document to a copy.
Types of authenticable documents: It is possible to authenticate public and private Mexican documents. However, according to Mexican law, a private document will not become a public document merely because it has been authenticated. In case of dispute, it will always be considered a private document.
Requirements for document authentication:
- Mexican authenticable document
- Mexican ID (passport or voter ID card issued by IFE or INE)
- Payment of fees on the day of your appointment by card (Visa, MasterCard or Maestro) according to the current public fees (follow this link)
